(AP) ? Libya's new prime minister on Tuesday put forward a Cabinet for parliamentary approval, but protesters stormed the building during the session, forcing a postponement of the vote on the new government.

Around 100 protesters, a mix of bearded civilians and self-proclaimed rebels, broke into the hall during a session in which Ali Zidan, the new prime minister, was telling the National General Congress that he tried to strike a geographic balance among different regions and cities.

The protesters faced little resistance as they entered, and a local TV station showed video of the break-in before it went off air. The protesters had various complaints about the nominated ministers, including that some had connections to the ousted regime of dictator Moammar Gadhafi.

Interim President Mohammed al-Megarif talked to the protesters, and they left the hall. Then they returned, forcing the parliament to postpone the vote on the new Cabinet until Wednesday.

"Let Libyans know the atmosphere in which we operate," al-Megarif said. "The least we can say about what happened is that it is pressure on the Congress members." He said criticism of the Cabinet was welcomed but appealed for a peaceful expression of opinion.

"The Congress represents legitimacy in this country," he said.

A year after the overthrow and death of Gadhafi, Libyans are seeking a broader distribution of political power among the country's three main regions, after decades of domination and discrimination by the dictator's highly centralized state based in the capital, Tripoli.

The new Cabinet faces the herculean task of reigning in a mushrooming number of armed groups, filled mostly with former rebel fighters who defeated Gadhafi's forces during last year's eight-month civil war. The government must also build state institutions such as the judiciary, police, military and others from scratch, and rebuild cities and towns demolished during the conflict.

Zidan, a former human rights lawyer chosen Oct. 14, is the second prime minister to be named by the 200-member parliament. Legislators dismissed his predecessor, Mustafa Abushaqur, after they said he had put forward unknown people for key Cabinet posts and proposed a government lacking diversity.

Zidan said he held talks with the country's political parties including the two biggest blocs in parliament, the Alliance of National Forces, led by liberal wartime Prime Minister Mahmoud Jibril, and the Muslim Brotherhood's political arm, the Justice and Construction Party. Such talks are seen important to ensure that his 27-member Cabinet lineup passes the vote of confidence.

The proposed Cabinet gives the interior and defense portfolios to ministers from Libya's second largest city, Benghazi, and reserves at least two posts for ministers from the third largest city, Misrata. Two proposed ministers are women. The protesters named the proposed foreign minister and religious endowment ministers as linked to Gadhafi's regime.

The new Cabinet will also have to deal with the displacement of tens of thousands of residents of the western town of Bani Walid. The town, a stronghold of Gadhafi's loyalists, fell in a battle to pro-government forces last week.

After rounding up a number of suspects, pro-government militias withdrew from the town. Abdullah Boushnaf, named head of Bani Walid's city council, complained the government had no plan to fill the vacuum and said the situation was "disastrous."

"We don't understand what is happening. The government made promises and said that there are plans to bring back the displaced, but nothing has happened until now. Looters are taking over everything from public to private properties," he said.

The chaos mounted with recent remarks from outgoing Defense Minister Osama al-Gweili, who claimed on Monday that the forces that took over Bani Walid were not under the government control, calling them just "militias."

Al-Gweili is from the western mountain town of Zintan, which has close ties with Bani Walid and whose fighters opposed military action against the town.

Al-Gweili's remarks underscore the absence of a clear mechanism of decision making by Libya's rulers.

Al-Megarif said earlier this month that the forces leading the offensive on Bani Walid had state backing, and his military chief of staff, Youssef al-Mangoush, said that he sent reinforcements. The contradictions show how tribal loyalties play major roles in decision making.

Honeybees harbor antibiotic-resistance genes

Tuesday, October 30, 2012

Bacteria in the guts of honeybees are highly resistant to the antibiotic tetracycline, probably as a result of decades of preventive antibiotic use in domesticated hives. Researchers from Yale University identified eight different tetracycline resistance genes among U.S. honeybees that were exposed to the antibiotic, but the genes were largely absent in bees from countries where such antibiotic use is banned. The study appears on October 30 in mBio?, the online open-access journal of the American Society for Microbiology.

"It [resistance] seems to be everywhere in the U.S.," says Nancy Moran of Yale University, a senior author on the study. "There's a pattern here, where the U.S. has these genes and the others don't."

Honeybees the world over are susceptible to the bacterial disease called "foulbrood", which can wipe out a hive faster than beekeepers can react to the infection. In the U.S., beekeepers have kept the disease at bay with regular preventive applications of the antibiotic oxytetracycline, a compound that closely resembles tetracycline, which is commonly used in humans. Oxytetracycline has been in use among beekeepers since the 1950s, and many genes that confer resistance to oxytetracycline also confer resistance to tetracycline.

Using sensitive molecular techniques, Moran and her colleagues screened honeybees from several locations in the United States and from Switzerland, the Czech Republic, and New Zealand as well as several wild bumblebees from the Czech Republic, for the presence and abundance of tetracycline resistance genes. They found that U.S. honeybees have greater numbers and a more diverse set of tetracycline resistance genes than honeybees from the other countries.

Moran says it is reasonable to expect to see widespread resistance among bees, considering the decades-long use of oxytetracycline in honeybee hives. "It seems likely this reflects a history of using oxytetracycline since the 1950s. It's not terribly surprising. It parallels findings in other domestic animals, like chickens and pigs," says Moran.

Moran notes that beekeepers have long used oxytetracycline to control the bacterium that causes foulbrood, but the pathogen eventually acquired resistance to tetracycline itself. Of the foulbrood pathogens Melissococcus pluton and Paenibacillus larvae, Moran says, "They carry tetL, which is one of the eight resistance genes we found. It's possible that the gene was transferred either from the gut bacteria to the pathogen or from the pathogen to the gut bacteria."

Switzerland, the Czech Republic, and New Zealand do not allow beekeepers to use oxytetracycline in hives, so it is perhaps predictable that honeybees and wild bumblebees from these countries harbored only two or three different resistance genes and only in very low copy numbers, suggesting that the bacteria did not require the genes very frequently.

The authors of the study point out that by encouraging resistance and altering the bacteria that live in honeybee guts, decades of antibiotic applications may have actually been detrimental to honeybee wellbeing. Studies have suggested that the bacterial residents of the honeybee gut play beneficial roles in neutralizing toxins in the bees' diet, nutrition, and in defending the bee against pathogens. By disrupting the honeybee microbiota and reducing its diversity, long-term antibiotic use could weaken honeybee resistance to other diseases. Hence, the treatment that was meant to prevent disease and strengthen the hive may actually weaken its ability to fight off other pathogens.

Moran says while the study is interesting from the perspective of honeybee health and could have implications for how honeybee diseases are managed, the presence of resistance genes in the honeybee gut doesn't pose a direct risk to humans. These gut bacteria, says Moran, "don't actually live in the honey, they live in the bee. We've never actually detected them in the honey. When people are eating honey, they're not eating these bacteria."

?All Knowledge Is Inferential? ? Bankruptcy Court Rules that ?To the ...

?Either you karate do ?yes? or karate do ?no.?? You karate do ?guess so? ? [you get squished] just like grape.? ? Mr. Miyagi, The Karate Kid

Attorneys often take common expressions for granted, but a recent decision in the United States Bankruptcy Court for the Southern District of Indiana reminds us to pay close attention to how to express the foundation for the facts asserted in supporting affidavits and declarations.

In Fredin Bros., Inc. v. Bankers Bank (In re Eastern Livestock Co.), Peoples Bank sought a determination that it was entitled to certain funds paid into the court by Fredin Brothers, Inc.? The dispute arose from a transaction in which Eastern Livestock bought 192 steers from Kansas farmers who were, in turn, financed by Peoples Bank.? To pay for the cattle, Eastern wrote a check to the farmers and Peoples Bank, which check was subsequently dishonored.? Meanwhile, Eastern had sold the steers to a third party, which sold the steers to Fredin Brothers, which then sold the cattle down the supply chain to other purchasers.? Fredin Brothers, which had not yet paid for the cattle, then filed an interpleader action so as to avoid having to pay twice for the same cattle.

Once the interpleader suit was removed and transferred to the Indiana bankruptcy court, Peoples Bank filed a motion for summary judgment seeking a determination that it was entitled to the funds paid into the court by Fredin Brothers in connection with the interpleader action.? Along with its motion for summary judgment, Peoples Bank included a sworn and notarized verification from its president (which was, pursuant to for 28 U.S.C. ??1746, akin to a stand-alone affidavit or declaration).? That sworn statement included a qualifier that the facts alleged in the motion were ?true and correct to the best of my knowledge.?? In opposing the bank?s motion, the chapter 11 trustee for Eastern Livestock argued (among other things), that the presence of this caveat demonstrated that the bank?s president would not be qualified to testify to these facts or to introduce the supporting materials at trial and that the motion must be denied because it failed to satisfy the requirement, pursuant to Rule 56 of the Federal Rules of Civil Procedure, that any sworn declaration or affidavit (or, in this case, verified complaint) must demonstrate that the declarant is competent to testify to the matters stated therein.

In support of its argument that the bank president?s verified statement should be disregarded, the Eastern Livestock trustee relied on the Seventh Circuit Court of Appeals? decision in Price v. Rochford, in which the circuit court held that a litigant?s verification ?based upon his own personal knowledge or upon his information and belief? did not suffice to show that the affiant could testify to the matters stated in his sworn statement.? Similarly, the trustee contended that ?to the best of my knowledge? was too great a qualifier on the sworn testimony.

Though the bankruptcy court ultimately denied the bank?s motion for summary judgment on other grounds, it rejected the trustee?s argument that ?to the best of my knowledge? invalidated the sworn statement from the bank?s president.? The court noted that it was not a ?subjunctive escape clause? like the language at issue in Price, and the qualifier did not suggest that the statement was based on secondhand information.? The court, citing Visser v. Packer Eng?g Assocs., wisely noted that ?all knowledge is inferential? and that the apparent caveat in the sworn statement was accordingly ?of no moment.?? Even though ?upon information and belief or upon personal knowledge? would not run afoul of Bankruptcy Rule 7056, ?to the best of my knowledge? was considered adequate evidence of competency to testify to the facts set forth in the sworn statement.

It is easy to ignore the jargon that so often crops up in legal writing, but attorneys and putative witnesses would be well-advised to consider their words wisely.? Though it can be tempting to include caveats to protect ourselves and our witnesses from making false statements under oath, Eastern Livestock reminds us that these hedges have real meaning, and should be considered carefully.

And that?s no bull.

28 USC Sec. 1746
Sec. 1746. Unsworn declarations under penalty of perjury
? ? Wherever, under any law of the United States or under any rule, regulation, order, or requirement made pursuant to law, any matter is required or permitted to be supported, evidenced, established, or proved by the sworn declaration, verification, certificate, statement, oath, or affidavit, in writing of the person making the same (other than a deposition, or an oath of office, or an oath required to be taken before a specified official other than a notary public), such matter may, with like force and effect, be supported, evidenced, established, or proved by the unsworn declaration, certificate, verification, or statement, in writing of such person which is subscribed by him, as true under penalty of perjury, and dated, in substantially the following form:

? ? (1) If executed without the United States: "I declare (or certify, verify, or state) under penalty of perjury under the laws of the United States of America that the foregoing is true and correct. Executed on (date).
(SIGNATURE)". ? ? (2) If executed within the United States, its territories, possessions, or commonwealths: "I declare (or certify, verify, or state) under penalty of perjury that the foregoing is true and correct. Executed on (date).
(SIGNATURE)".

Rule 56. Summary Judgment
? ? (a) Motion for Summary Judgment or Partial Summary Judgment. A party may move for summary judgment, identifying each claim or defense ? or the part of each claim or defense ? on which summary judgment is sought. The court shall grant summary judgment if the movant shows that there is no genuine dispute as to any material fact and the movant is entitled to judgment as a matter of law. The court should state on the record the reasons for granting or denying the motion.
? ? (b) Time to File a Motion. Unless a different time is set by local rule or the court orders otherwise, a party may file a motion for summary judgment at any time until 30 days after the close of all discovery.
? ? (c) Procedures.
? ? (1) Supporting Factual Positions. A party asserting that a fact cannot be or is genuinely disputed must support the assertion by:

? ? (A) citing to particular parts of materials in the record, including depositions, documents, electronically stored information, affidavits or declarations, stipulations (including those made for purposes of the motion only), admissions, interrogatory answers, or other materials; or
? ? (B) showing that the materials cited do not establish the absence or presence of a genuine dispute, or that an adverse party cannot produce admissible evidence to support the fact.

? ? (2) Objection That a Fact Is Not Supported by Admissible Evidence. A party may object that the material cited to support or dispute a fact cannot be presented in a form that would be admissible in evidence.
? ? (3) Materials Not Cited. The court need consider only the cited materials, but it may consider other materials in the record.
? ? (4) Affidavits or Declarations. An affidavit or declaration used to support or oppose a motion must be made on personal knowledge, set out facts that would be admissible in evidence, and show that the affiant or declarant is competent to testify on the matters stated.
? ? (d) When Facts Are Unavailable to the Nonmovant. If a nonmovant shows by affidavit or declaration that, for specified reasons, it cannot present facts essential to justify its opposition, the court may:

? ? (1) defer considering the motion or deny it;
? ? (2) allow time to obtain affidavits or declarations or to take discovery; or
? ? (3) issue any other appropriate order.

? ? (e) Failing to Properly Support or Address a Fact. If a party fails to properly support an assertion of fact or fails to properly address another party?s assertion of fact as required by Rule 56(c), the court may:

? ? (1) give an opportunity to properly support or address the fact; ? ? (2) consider the fact undisputed for purposes of the motion; ? ? (3) grant summary judgment if the motion and supporting materials ? including the facts considered undisputed ? show that the movant is entitled to it; or ? ? (4) issue any other appropriate order.

? ? (f) Judgment Independent of the Motion. After giving notice and a reasonable time to respond, the court may:

? ? (1) grant summary judgment for a nonmovant; ? ? (2) grant the motion on grounds not raised by a party;or ? ? (3) consider summary judgment on its own after identifying for the parties material facts that may not be genuinely in dispute.

? ? (g) Failing to Grant All the Requested Relief. If the court does not grant all the relief requested by the motion, it may enter an order stating any material fact ? including an item of damages or other relief ? that is not genuinely in dispute and treating the fact as established in the case. ? ? (h) Affidavit or Declaration Submitted in Bad Faith. If satisfied that an affidavit or declaration under this rule is submitted in bad faith or solely for delay, the court ? after notice and a reasonable time to respond ? may order the submitting party to pay the other party the reasonable expenses, including attorney?s fees, it incurred as a result. An offending party or attorney may also be held in contempt or subjected to other appropriate sanctions. (As amended Dec. 27, 1946, eff. Mar. 19, 1948; Jan. 21, 1963, eff. July 1, 1963; Mar. 2, 1987, eff. Aug. 1, 1987; Apr. 30, 2007, eff. Dec. 1, 2007; Mar. 26, 2009, eff. Dec. 1, 2009; Apr. 28, 2010, eff. Dec. 1, 2010.)

Bankruptcy Rule 7056 provides that Rule 56 of the Federal Rules of Civil Procedure applies in adversary proceedings in bankruptcy court. In turn, Federal Rule 56 provides that ?[a]n affidavit or declaration used to support or oppose a motion must be made on personal knowledge, set out facts that would be admissible in evidence, and show that the affiant or declarant is competent to testify on the matters stated.? Both impliedly and by reference, Rule 56 incorporates Rule 602 of the Federal Rules of Evidence, which provides that ?[a] witness may testify to a matter only if evidence is introduced sufficient to support a finding that the witness has personal knowledge of the matter.?

Asian markets gain in face of US superstorm

BEIJING (AP) ? Asian markets gained Wednesday after Wall Street stayed closed for a second day as a hurricane ravaged the East Coast of the United States.

Oil edged up in Asian trading but stayed below $86 a barrel as investors waited for U.S. employment data that are expected to show little improvement.

In Tokyo, the regional heavyweight, the benchmark Nikkei 225 was up 1.2 percent at 8,943.96. Hong Kong added 0.5 percent to 21,538.6 while South Korea's Kospi added 0.7 percent to 1,912.89.

Global markets stayed calm despite Hurricane Sandy's disruption of U.S. trading. Losses Monday in Europe were recovered Tuesday.

"While the economic and social cost of the Superstorm will be counted over coming days, markets in general appear to have brushed off their worst fears," said Credit Agricole CIB economist Dariusz Kowalczyk in a report.

The New York Stock Exchange's decision to close Tuesday marks the first time weather has stopped trading for two straight days since 1888. Experts expect storm damage of about $20 billion, about half of that insured.

The NYSE said it would reopen Wednesday using backup generators because power is out in much of downtown Manhattan.

Wall Street experts had feared another delay might lead to a dangerous backlog of customer orders to buy and sell stock. It could have dealt a blow to the image of U.S. markets, already hurt by investor distrust, sudden market swings and a series of trading glitches, including the botched IPO of Facebook.

Elsewhere in Asia, Sydney's S&P ASX 200 gained 0.7 percent to 4,517. Taiwan's Taiex was off 0.2 percent at 7,166.05 and Singapore declined 0.2 percent to 3,031.16. India's Sensex was flat at 18,249.1.

Futures for the Dow Jones industrial average declined 0.1 percent to 13,024 while the Standard & Poor's 500 rose by a similar margin to 1,408.50.

In the United States, investors were looking ahead to Friday's Labor Department release of jobs data that are expected to show little change in payrolls.

"The trend has gone absolutely nowhere since April. Markets expect no change this week," DBS Bank Ltd. in Singapore said in a market commentary.

Japan's central bank lowered its economic outlook on Tuesday, saying it expected growth of 1.6 percent in the year ending in March, down from previous forecasts of 2 percent.

"The possibility is increasing that the economy is heading towards a technical recession," said DBS.

Japan's economy has been hobbled by weakness in its export sector, which has been hit hard by a slowdown in demand from recession-mired Europe and a strong yen, which makes Japanese products more expensive abroad.

Investors also were watching China, where a once-a-decade handover of power to younger Communist Party leaders is due to start at a party congress next week.

The euro was unchanged at $1.2962. The dollar fell slightly to 79.59 yen from 79.60 yen late Tuesday in New York.

Benchmark crude oil for December delivery rose 26 cents to $85.94 per barrel in electronic trading on the New York Mercantile Exchange. The contract rose 14 cents on Tuesday to $85.68.

Cynthia Carroll to step down as Anglo-American CEO

(AP) ? Cynthia Carroll will step down as chief executive of mining company Anglo American PLC after almost six years in the job, the company announced Friday.

Carroll, who is to leave the company as soon as a successor is found, made no reference to reports that some investors had lost faith in her leadership following a series of controversial events including a series of strikes in South Africa and a dispute in Chile. Earlier this month, the rating service Standard & Poor's lowered its outlook on the company from "stable" to "negative" because of the turmoil in South Africa.

"Of course, we always listen to our shareholders very carefully. However, today's decision is very much based on Cynthia's decision," Anglo's chairman John Parker said in a video interview posted on www.cantos.com .

Anglo American shares opened 1.8 percent higher in London at 1,890 pence.

In an video interview posted on, Anglo chairman John Parker

Carroll, a 55-year-old American, was appointed chief executive in 2007. She was the first non-South African and first woman to lead the company.

"It is a very difficult decision to leave, but next year I will be entering my seventh year as chief executive and I feel that the time will be right to hand over to a successor who can build further on the strong foundations we have created," she said.

Trained as a geologist, Carroll started her career with Amoco. She joined Alcan in 1989, rising in 2002 to the posts of president and chief executive officer of Alcan's primary metals group.

Carroll will also be stepping down from her roles as chairman of De Beers, an appointment announced earlier this month, and of Anglo American Platinum.

Anglo American posted a record operating profit of $11.1 billion in 2011. In that year it paid $5.1 billion for the Oppenheimer family's 40 percent stake in De Beers, raising Anglo's stake to 85 percent.

In the first half of this year, operating profit slumped by 38 percent and net profit fell 70 percent as the group was hit by lower commodity prices and higher costs.

Anglo's market capitalization has fallen more than 25 percent since Carroll joined the company, the Financial Times said.

Anglo American also became embroiled in a dispute with Chile when it announced in 2011 that it had agreed to sell its 24.5 percent stake in Anglo American Sur, its copper assets in Chile, to Mitsubishi for $5.4 billion. That sale was challenged by Codelco, Chile's state-owned copper miner, which had an option to take a 49 percent stake.

Codelco and Anglo American resolved the dispute in August as Anglo reduced its holding in AA Sur from 75.5 percent to 50.1 percent, while a Codelco-Mitsui joint venture took a 29.5 percent interest.

Anglo American's operations in South Africa have been set back by labor unrest since September, when more than 10,000 miners at Anglo American Platinum's operations outside Johannesburg went on strike demanding 16,000 rand (about $1,800) in monthly pay.

Amplats, the world's top producer of platinum, insisted the strike is illegal.

The company fired 12,000 workers en masse earlier this month, drawing condemnation from the influential Congress of South Africa Trade Unions, COSATU. COSATU has called for a massive street protest Saturday in support of the dismissed workers, who have threatened to make the company's operations ungovernable if they are not reinstated.

Mpumi Sithole, a spokeswoman for Amplats, said Thursday that the company stands by its decision to fire the workers.

Eva Longoria signs first-look deal with Universal TV

LOS ANGELES (TheWrap.com) - Eva Longoria has signed a first-look development deal with Universal Television, the studio and NBC Entertainment announced Thursday.

Longoria is executive producer of NBC's upcoming "Ready for Love," a new relationship series from Renegade 83, UnbeliEVAble Entertainment and Universal Television.

The pact announced Thursday is a non-writing, executive producer agreement with Longoria and her production company UnbeliEVAble Entertainment.

"Having Eva Longoria on our team is a huge advantage for our alternative program development as we have pleasantly discovered in implementing her ideas for ?Ready for Love,' which is shaping up as a terrific and upbeat series," said Paul Telegdy, president, alternative and late-night programming, who made the announcement with Jennifer Salke president of NBC Entertainment.

"We know that this new agreement with Eva Longoria is significant in continuing what has already been a productive relationship," said Salke. "She has exceptional energy, vision, a prestigious name and the creative knack for finding compelling new concepts for our growing studio."

Longoria is best known for her starring role as Gabrielle Solis on the long-running series "Desperate Housewives."

"I am thrilled and excited to join Universal Television on what promises to be a wonderful and creative partnership, especially given all of the recent success at both the studio and the NBC network," said Longoria.

The Facebook Demetricator Removes the Numbers from Facebook, Leaves You No Excuse for Not Working

The Facebook Demetricator Removes the Numbers from Facebook, Leaves You No Excuse for Not WorkingThe Facebook Demetricator Removes the Numbers from Facebook, Leaves You No Excuse for Not Working Chrome/Firefox: Part useful tool and part social experiment, Ben Grosser's Facebook Demetricator removes all of the numbers that keep our eyes glued to Facebook?likes, new messages, comments, notifications, all of them are gone. With them removed, you can scan the site for the information you want, read without worrying about killing too much time interacting, and get back to work.

Facebook is distracting enough, but the little hooks that are designed to keep us there all do their part to pull in our attention. The Facebook Demetricator erases those numbers as though they were never even there. Ben describes the extension this way:

Facebook Demetricator is a web browser addon that hides these metrics. No longer is the focus on how many friends you have or on how much they like your status, but on who they are and what they said. Friend counts disappear. '16 people like this' becomes ?people like this'. Through changes like these, Demetricator invites Facebook's users to try the system without the numbers, to see how their experience is changed by their absence. With this work I aim to disrupt the prescribed sociality these metrics produce, enabling a network society that isn't dependent on quantification.

Of course, if you already have AdBlock Plus installed, the AntiSocial plugin can do much of this for you too, and we've shown you how to use SocialFixer to improve your Facebook experience as well. Either way, if the idea piques your interest, or you think it'll make you more productive on or off Facebook, it's available for Chrome and Firefox at the link below.

Survey shows China's manufacturing improving

BEIJING (AP) ? China's manufacturing improved this month, adding to signs a recovery might be taking shape after a sharp slump in the world's No. 2 economy.

A preliminary version of HSBC's monthly purchasing managers' index rose to a three-month high of 49.1 points on a 100-point scale, the bank said Wednesday. That still was below the 50-point level that indicates a contraction but was a strong improvement from September's 47.9.

That added to data last week that showed retail sales and investment picking up. Economic growth in the three months ending in September fell to a three and a half year low of 7.4 percent but the decline was much gentler than in earlier quarters. Activity grew by 2.2 percent over the previous quarter, the biggest such gain in a year.

HSBC Corp. said the preliminary reading is based on responses from 85 to 90 percent of the 420 companies it surveys each month. The final index is due out Nov. 1.

"October's flash PMI reading continues to recover for the second month, thanks in part to a gradual improvement in the new orders index, which picked up to a six-month high," said HSBC economist Hongbin Qu in a statement.

But Qu warned that challenges "still abound" and the job market faces pressure.

"This calls for a continuation of policy easing in the coming months to secure a firmer growth recovery," he said.

The Chinese numbers are rare good news for the world economy, which has slowed as Europe's chronic debt crisis worsened and the American economy stagnated.

Analysts have cautioned that a Chinese recovery is likely to be "L-shaped," meaning the decline might have stopped but improvements in growth should be gradual. That would be a setback for exporters of commodities and other goods that are counting on China to help drive a rebound in global demand.

The slowdown was due largely to government curbs imposed to cool an overheated economy and reduce reliance on exports by encouraging more domestic consumption. The slump worsened last year after global demand for Chinese goods plunged unexpectedly.

Chinese leaders have cut interest rates twice since early June and are pumping money into the economy through high spending by state companies and on building airports and other public works but have avoided a large stimulus.

Data last week showed retail sales rose 14.4 percent in September, accelerating from the first half's 14.1 percent growth. Investment in factories and other fixed assets improved, rising 20.5 percent in the first nine months of the year, up from a 20.2 percent rate for the first eight months.

China's expansion is strong compared with the United States and Japan, where this year's growth is forecast in low single digits, but the slowdown has been painful for companies that depend on strong demand for new factories and other goods.

The slump raised the risk of job losses and unrest, posing a challenge to the ruling party as it prepares for a once-a-decade handover of power to younger leaders.

Premier Wen Jiabao, the country's top economic official, said last week growth appeared to be stabilizing and expressed confidence China can meet its official targets for the year. Wen gave no growth forecast or a possible time frame.

The ruling Communist Party's official growth target this year is 7.5 percent, well below the double-digit levels of recent years.

Growth could rebound to about 8 percent in the current quarter, said Credit Agricole CIB economist Dariusz Kowalczyk in a report.

"It is increasingly clear that no further measures to stimulate growth are needed," said Kowalczyk. "Markets may be disappointed to realize that Chinese recovery will be gradual and no new stimulus is forthcoming."

Why Are Mobile Ads So Cheap?

Mobile Ads

Mobile may be the future, but right now mobile ad units still command a lower price point on average than print and web advertisements.

Earlier this year, the renowned venture capitalist and former Wall Street analyst Mary Meeker gave her much-watched annual presentation on Internet trends, during which she revealed a startling statistic based on her own research: The effective cost per thousand impressions (CPM) for desktop web ads is about $3.50, while the CPM for mobile ads is just $0.75.

More recently, leading mobile ad platform Opera Software broke down the average cost for mobile ads by device, and found that even the iPhone, which has the highest average CPM for mobile ads of any smartphone, at $2.85, still falls short of that CPM for web ads on a desktop. Importantly, Opera?s mobile ad estimates likely skew higher because its business focuses on mobile display ads rather than mobile search ads, which tend to have a much lower CPM.

Print ads, by comparison, can command rates of as much as $100 per thousand impressions.

Opera Mobile Ad Chart

To be sure, there are certainly instances when a particular kind of mobile ad costs more than print and desktop ads. For example, when Apple launched its mobile advertising unit iAd in 2010, the CPM was initially somewhere between $10-$15 (or more, depending how you calculate the click-through rates.)

However,?in the aggregate, mobile ads continue to be cheaper than web and print, due to a combination of limited screen real estate, a lower price point for search ads and less sophisticated advertising technology to entice marketers to pay more.

The Problem With Mobile Search Ads

At the moment, marketers devote more advertising dollars in total to mobile search ads than to mobile display ads, according to the most recent data from eMarketer. However, the CPM rates of these search ad units tend to be significantly lower than for display ads, for a couple of reasons.

eMarketer Mobile Ad Spend Chart
Mobile display ads refer to banner advertisements, video placements and other rich media experiences, which are thought to be more engaging and therefore more valuable to advertisers. Search ads, on the other hand, are basically synonymous with Google listings ? in fact, Google currently controls 95% of the mobile search advertising market. According to analysts, these search ad listings have not yet proven themselves particularly effective models for encouraging mobile users to make purchases.

?Advertisers know that consumers are less willing to make purchases ? especially large purchases ? on their phones, so a lot of the money that goes into direct response advertising that fuels ecommerce on desktops doesn?t move over to mobile,? says Clark Fredrickson, VP of communications at eMarketer. Indeed, Fredrickson suggests that Google is aware of the low conversion rate for search ads and keeps ad prices low as a result.

SEE ALSO: How Google Could Lose Its Grip on Mobile Search

Google, for its part, wouldn?t comment on pricing trends for mobile search ads, but the company?s third quarter earnings suggest that low mobile ad rates are dragging down its overall cost per clicks. Google reported Thursday that its paid clicks were up 33% year-over-year, but its cost per clicks declined 15% year-over-year. Even so, Google touted the success of mobile ads so far for those marketers who ?get the experience right,? in a statement provided to Mashable.

?While it?s still early days, mobile has shown incredible momentum, and it?s become clear that, when done right, mobile works for advertisers,? says Jason Spero, head of global mobile sales and strategy at Google.??We?re seeing this today with immersive brand building and direct response campaigns that take proximity, call and device capabilities into account. When marketers get the experience right and measure effectively, mobile can be a game-changer for them.?

The problem is that getting the experience right is often easier said than done. Not only is the conversion rate lower, but there are concerns that the smaller?screen size on mobile devices make search and display ads seem more obtrusive and less appealing to consumers. As a result, publishers and advertisers can?t just shrink down their desktop web ads for mobile and call it a day; they need to rethink their strategies.

Marketers Remain Hesitant About Spending on Mobile

U.S. mobile ad spending nearly doubled in the first half of this year to $1.24 billion, according to the most recent data from the Interactive Advertising Bureau. However, mobile still only represented 7% of total online ad spending for that time period.

?Mobile is something that everyone is excited about, but we?re still seeing a very small share of ad dollars at this point,? Fredrickson says. ?You?re starting to see a bigger and bigger gap between the amount of time people spend on mobile devices and the amount of dollars spent there.?

IAB Ad Spending Chart
For marketers, a big part of the hesitation is that mobile advertising technology is still in its infancy; many of the tools they?ve come to rely on with desktop web ads have yet to make their way to mobile.

?The desktop industry had the better part of 15 years to build profiles and have cookie exchanges and re-targeting engines that have made display advertising pretty interesting,? says?Mahi de Silva, executive VP of consumer mobile at Opera Software. ?That technology just doesn?t work in mobile.?

Some of this might never come to mobile. Cookies, for example, are a key way that advertisers have managed to target desktop users with specific ads related to their browsing history, but today?s mobile browsers do not support cookies. This has forced advertisers to rely on other information, such as the mobile device?s unique ID number, which gives the advertiser far less data about the user to go on.

Beyond that, to really make the most of mobile advertisements, marketers need to invest in additional efforts, like building mobile landing pages and a system to capture users who do click through the ads.?Combine this with lingering doubts about the effectiveness of these ads in converting clicks into customers and the deficit of targeting tools, and you have a marketing option slow to take off.

The Future of Mobile Ad Spending

While mobile ads may be cheaper on average now, analysts we spoke with expect prices to tick up over the next few years, as advertising technology improves and consumer behavior on mobile devices evolves.

Both Fredrickson and de Silva expect that publishers will roll out more sophisticated ad tools, including better targeting intelligence and profile management, which should persuade marketers to make bigger ad buys and boost CPMs. Indeed, Facebook is already testing a system that lets marketers place mobile ads on third party apps and websites based on Facebook?s data about what content its users have Liked.

While some desktop features like cookies may be difficult to replicate on mobile, there are opportunities for other marketing tools. This could include targeting ads to consumers based on their GPS locations, through geofencing technology. In this scenario, companies would be able to push out promotions to consumers as they they walk by particular stores.

Meanwhile. mobile search ad prices should continue to increase as consumers get more comfortable making bigger purchases on their phones and tablets. ?As mobile commerce starts to grow?you are going to see more and more interest from advertisers who are looking to convert people,? Fredrickson says.

Moverover, de Silva argues that increasing tablet adoption should drive up the average CPM rate for mobile ads as well. According to the Opera study, iPads in particular had a CPM of $3.96 ? more than a dollar higher the iPhone ? but accounted for less than 7% of mobile traffic in the second quarter of this year. As it becomes more popular, it could boost the average rate for mobile ads overall.
